RSBandBUpdate! episode 253 and the (brief) discussion of "finders, keepers" popped up.

Under common property law, there are three categories property may fall in to:

    Lost- property found where the true owner most likely did not intend to place it, i.e. dropped wallet out of pocket when walking through airport
    Mislaid- property found where the true owner most likely did intend to place it, i.e. using iPhone in cafe and forgot to pick it up again when he left
    Abandoned- property that the owner intended to leave in that place

In most countries, abandoned property becomes becomes property of whoever found it, often with the exception of wreckages which become state property.

For mislaid property, it is deemed the responsibility of the the person who found it to surrender the item to the owner of the premises found upon. The premise's owner then takes up responsibility to hand back the property to the true owner should he return. If the true owner does no return, it then becomes property of the premise's owner.

Finally, lost property. Depending on the country, the law may state either of the following. The law may state that lost property be treated as mislaid property, therefore the finder hands the item to the premise's owner, who then returns it to the true owner should he return, or keep it if he doesn't. The second option is for the law is to state that whoever finds the item has the right to claim possession over anyone except the true owner. In areas where a lost property desk exists, it may or may not be law for the finder to hand it in, and if not, it is then up to the premise's owner to enforce the use of such service.

Interesting way of putting it. I think people know it is better to turn in a lost item than to keep it for themselves. One time in high school, I found a $20 bill lying on the floor, untouched in one of the long corridors. I picked it up and told my friends I was going to turn it in tot he deans office. They thought I was crazy since it was a $20 and no one would ever know the difference. I still turned in the bill. The dean thanked me for my honesty and said if no one came in to get it, I could keep it. After a week or so, when no one came in, I got the $20 back and was able to keep it. Though in the end it was somewhat pointless to turn it in, the process of trying to return something to the owner should be followed. I know how it feels to lose something and not remember where it was. Just the other week, I misplaced my student ID in a restaurant, but didn't realize until later. Fortunately, they had my ID when I called and it was no trouble to get it back. Regardless who found it, I think it is important to try and return was is not yours to whomever it belongs to. Besides doing the right thing, you might end up getting a reward, too. :D

Ehh i always view it as dishonest and try to return it. Just the other day i was using one of those self serve check outs and saw a bottle of wine on it and the receipt was still in the machine no idea how someone can forget to take that with them but there it was. I could of easily of packed it in my bag and walked off.

After all i had the receipt and nobody is paying attention to what i'm doing really. Still handed it in to some guy who worked there and just explained in the hopes that if someone comes back in asking for it he can give it to them.

this reminds me of when me and my mate found $600 in a wallet.

we kept the moolah, and spent them all on liquor, drugs (well, he took them, i dont do drugs), and some fun at the red light district.

lasted for 3 days. oh well, easy come easy go right? :p

if you found something and turn it to the police. rule of thumb if nobody is looking for it, after 30 days you can have it back.

i once found a Mercedes car keys on the ground. too bad there was no mercedes around so i had no idea who it belonged to.

turn it in to the security guard near my school and went home. no idea if they came to pick it up honestly.

usually i give it back unless i find a 20 in the middle of a parking lot... they would be long gone before they knew it was missing.

my mom and i once found 40 bucks doing that.

that was nice

Personally, I make my moral judgments on a case by case basis. For example, I was out snowboarding for the day with my dad and he lost his goggles in the lodge. He noticed right after we got out, so he went back in to get them...funny how things mysteriously vanish in minutes.

Later on when we were taking off our boots, we found a nice pair of gloves that someone had left behind. Had to make up for those lost goggles somehow :lol:
