Do you think he has the right to demand money now? Idont think he has a right, or he can even win, but I do think that his xwife is pure scum.

To think you save someone's life and then they cheat on you... wow.

His wife, 44-year-old Dawnell Batista, had an affair with her physical therapist in 2003, he said. She recovered from the knee injury, but he says her low blow has him all out of joint.

"I saved her life and then to be betrayed like this is unfathomable. It's incomprehensible," he told the Post. "She engaged in an extramarital affair and refused to go to marital counseling and reconciliation."

Two years after the affair began she filed for divorce, and Batista accuses her of trying to limit his access to their three children, ages 8, 11 and 14.

"She slapped me with divorce papers in the operating room while I was trying to save another patient's life," he told the Post.

Divorce attorney Dominic Barbara said this case was a first, and that he arranged for a medical expert to determine his client's kidney's worth.

"This has never been done before in the state of New York," Barbara said.

Well as wrong as it is... I don't see how he should get anything.. I mean sure he gave away his kidney , but it was his choice she didn't put a gun to his head. IT's a risk you take when you do something like that. Trust me i'd be really mad if it happened to me, but you can't expect to sue and everything else cause like I said it's at ur own risk and choice

a kidney isnt a dog, once you give one away theres no going back, he should have known that before he gave it away.
and he shouldnt have given it away just because it was his wife.

he GAVE her his kidney, he didnt rent it out.

he shouldnt get any money, and he should shut up and be happy to save a life.

I think he should get the money, and here's my logic in it.

When some people file for a divorce, they want the ring back that they gave to their spouse. I don't see how this is any different, he gave her something considered valuable, she cheated on him, he wants back what he gave her (or the cash equivalent).


Ya I know h'm going to get flamed.


(Heard about this earlier on the radio btw.)

he should definentaly NOT have to give back the kidney, I don't think someone should have a chance to legally die just because someones angry.

A kidney to save someones life is a bit different than a wedding ring. What if i, for example donate my organs when i die does that give my family the right to ask favours of whoever got it? Course not. What about donating blood?

Ya but after your dead it's different, and your family will more than likely not know who received your organs.

His wife essentially used him to get the kidney though, and then moved onto the next man.

i actually thought it was amusing.
we're learning the body in biology and it came up.
i think he's a lunatic.
he has no right to take it back, it's her property now.

No he shouldn't get anything. Other, that is, than being charged for attempted murder. Because ultimately that is what he would be doing if his ex wife had to return a kidney. Obviously, he isn't actually asking for the kidney - just money! Funny that, here is a doctor (funny kind of doctor!) asking for payment for a body part - yet again another illegal act. This is one pathetic man.
