It's both.

It's artistic, but also a crime to make them. (Atleast in most cases: in some places in Finland you're allowed to do graffiti.)

If it's more then writing your own name, then it's art. I live in New York and see some wickedly awesome graffiti around the city. So I don't think it's much of a crime.

If it's on public property without the consent of the owner or the town, it's a crime, if it's something in a backyard and/or with permission from whoever, it's art.

I also went to another town, forgot the name, but it had murals all over the place. Fantastic paintings. ;)

It could be a crime depending on where you do it, but it can still be a crime in the form of art, can't it? Then it depends on who did it and if they did more than spraypaint their initials.

I don't see how graffitied initials can't be the expression of creative skill and imagination. It's not "just initials" a lot of the time.

When I went to Rome in Italy, Me and my family went into the underground to catch the train back to our hotel and this one train was completely covered in graffiti on the one side, I suppose the cleaners just got annoyed with having to try and get it off everytime someone did it but it really did look amazing.
I'm pretty sure I took a picture of it, I'll try and find it for you guys.
