well i cant even use the frist layer.....and when i get a new layer, ill select red to be my brush color in a couple seconds it will go back to black... does anybody know what is going on with it....

Are you sure you aren't just..switching layers?

If i remember rightly each layer can have a different set colour or whatever.

This happend to me already. I have CS2 tho.

But when this happend to me I already had an image open trying to color it in. It has like a block on it where it keeps in black and white. Were you trying to color something or edit?

Make sure your colour mode is set to RGB and not Grayscale. I have been bit by this before. This sounds like what was happening to me so try this:
Image -> Mode -> RGB Color
